A federal judge in Oakland, California, recently established a March 2026 trial date for Mr. Musk’s lawsuit with the intention of expediting the legal proceedings.
US District Judge Yvonne Gonzalez Rogers previously declined to grant Mr Musk an injunction that would temporarily halt OpenAI’s conversion from a non-profit to a for-profit company.
She additionally mentioned her expectation for Mr. Musk to provide testimony in the case.
Musk claims that OpenAI deviated from its original purpose as a non-profit organization aimed at developing AI for human welfare, thus violating an agreement.
He departed from the company in 2018.
“This is about control. This is about revenue. It’s basically about one person saying, ‘I want control of that startup’,” said Ari Lightman, professor of digital media and marketing at Carnegie Mellon University.
Lightman stated that this issue has diverted attention away from ensuring AI is both secure and fair.

OpenAI alleges that Musk has “spread misinformation about them,” according to an X post made on Wednesday, further stating “Elon hasn’t been focused on the mission; he’s always had his own agenda.”
Musk’s xAI competes with OpenAI but hasn’t kept pace thus far. Recently, xAI acquired Musk’s former social network X, previously known as Twitter.
Musk asserts that the merged entity, XAI Holdings, has a valuation exceeding $100 billion.
In February, Musk proposed an unexpected offer to acquire OpenAI, proposing to purchase it for $97.4 billion; however, this was declined by Mr. Altman when he responded with “no thanks, but if you wish, we’ll buy Twitter for $9.74 billion instead.”
